Adakah Pindaan Perlembagaan Perlu Untuk Laksana Hudud?

Kerajaan PAS Kelantan bakal mengemukakan rang undang-undang persendirian di Dewan Rakyat bagi membolehkan Enakmen Kanun Jenayah Syariah (II) 1993 dilaksanakan di negeri tersebut. Seluruh umat Islam di Malaysia umumnya, dan di Kelantan khususnya, sudah tentu mengimpikan perlaksanaan suatu undang-undang jenayah yang dibuat berdasarkan syariah Islam.

Namun begitu, umat Islam juga perlu maklum mengenai beberapa perkara agar berupaya menilai sama ada sesuatu tindakan atas nama syariah itu benar-benar dibuat untuk menegakkan syariah. [Lagi]

Sodomy, which literally translates to liwat in Malay, is simply defined as “sexual relations between male persons” in Section 2 of the Syariah Criminal Offences (Federal Territories) Act 1997. This is in contrast to Section 377A, where the offence of carnal intercourse against the order of nature is more illustratively detailed as “sexual connection with another person by the introduction of the penis into the anus or mouth of the other person”.

Looking at both of these definitions, it is evident that Section 377A has a wider meaning as it not only include “sexual relations between male persons” as defined by the Syariah Criminal Offences (Federal Territories) Act, but can also include sexual relations between a male and a female. [Lagi]

Malaysia has a Muslim population of 61.3%, which effectively categorizes it as a multi-cultural country with a small Muslim majority. Apart from Malaysia, there are only two other multi-cultural, former British colonies with a small majority of Muslims, namely Brunei and the occupied territory of Palestine (which includes Israel). Out of these three states, only two own a constitution which expressly uphold Islam as the religion of the country or the federation. These two states are Malaysia and Brunei – both Malay governments. [Lagi]

The Federal Constitution, the highest law of the land, provides that criminal law will fall under the jurisdiction of the federal powers, while syariah law can be created by the states’ own legislative assembly.

The Ninth Schedule, List I, Paragraph 4 places crime-related laws under the authority of Parliament (Federal). The Ninth Schedule, List II, Paragraph 1 provides that the state government does not have the power to create any criminal law.

The addition of clause 1A to Article 121 of the Federal Constitution had effectively granted jurisdictional independence to the syariah courts by protecting them against interference by the civil courts. However, with the newly-gained powers, syariah state enactments similar to the Syariah Criminal Offences (Federal Territories) Act 1997, have incorporated the criminal offence of liwat, to be tried by the syariah court, when another genuinely identical criminal offence is already specified under Section 377A of the Penal Code.
